1. Acceptance of these Terms

These Terms of Service (“Terms”) form a binding agreement between you and {{LEGAL_ENTITY}} (“TattooWallah”, “we”, “us”, or “our”) and govern your access to and use of the TattooWallah website and mobile applications (the “Platform”). By accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

2. Who we are — marketplace and intermediary

TattooWallah is an online marketplace and intermediary that connects customers with independent, third-party tattoo artists and studios (“Artists”). We operate as an “intermediary” under Section 2(1)(w) of the Information Technology Act, 2000, and rely on the safe-harbour protections of Section 79 of that Act and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

  • The Artist — not TattooWallah — provides the tattooing service. Artists are independent professionals. We are not a party to the service contract between you and an Artist, and we do not control or supervise how Artists perform their services.
  • We provide technology to discover Artists, view flash designs and portfolios, check availability, and make bookings.
  • We do not endorse, guarantee, or assume responsibility for any Artist, design, advice, or service offered through the Platform.

3. Eligibility — 18+ only

You must be at least 18 years old and able to form a legally binding contract under the Indian Contract Act, 1872 to use the Platform, make a booking, or receive a tattoo. By using the Platform you represent and warrant that you meet these requirements. We may refuse service, and Artists may decline to provide a tattoo, where age or eligibility cannot be verified.

4. Your account

You register using your mobile number and a one-time password (OTP). You are responsible for keeping your device and login factors secure and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorised use.

5. Bookings, pricing, and payments

  • When you book, you request an appointment with the selected Artist. A booking is a request to that Artist and may be subject to the Artist’s confirmation and their own terms.
  • Prices, design details, sizes, and availability are set and provided by Artists. Final pricing may vary based on the consultation, design complexity, placement, and size.
  • Any payments, deposits, refunds, rescheduling, and cancellation terms are agreed between you and the Artist unless we expressly state otherwise at the point of booking.
  • You agree to attend confirmed appointments on time and to follow the Artist’s pre-care and aftercare instructions.

6. Health, safety, and consent

Tattooing is a permanent procedure that carries inherent risks. Before your appointment, disclose relevant health conditions to the Artist, review and sign any consent form the Artist requires, and follow all aftercare guidance. You are responsible for assessing whether a tattoo is suitable for you. TattooWallah does not provide medical advice.

7. Acceptable use

You agree not to:

  • Use the Platform for any unlawful, fraudulent, or harmful purpose.
  • Post or upload content that is illegal, infringing, obscene, defamatory, harassing, or that you do not have the rights to share.
  • Misrepresent your age or identity, or impersonate any person or entity.
  • Interfere with, disrupt, or attempt to gain unauthorised access to the Platform, its systems, or other users’ accounts.
  • Scrape, copy, or reuse Platform content or Artist portfolios except as permitted by law.

8. Your content

You retain ownership of reference images and other content you submit. You grant us a limited, non-exclusive licence to host, store, display, and transmit that content as needed to operate the Platform and fulfil your bookings. You are responsible for ensuring you have the rights to any content you upload.

9. Reviews and ratings

You may be able to review Artists. Reviews must be honest, based on your genuine experience, and must not contain unlawful, abusive, or misleading content. We may moderate or remove reviews that violate these Terms.

10. Third-party services

The Platform relies on third-party services — including MSG91 (OTP / SMS / WhatsApp), Amazon Web Services (hosting), Sentry (error monitoring), Microsoft Clarity (analytics), and Expo Push (push notifications). Your use of the Platform involves these providers as described in our Privacy Policy. We are not responsible for third-party services’ own acts or omissions.

11. Intellectual property

The Platform, including its software, design, logos, and content (other than user and Artist content), is owned by or licensed to {{LEGAL_ENTITY}} and protected by applicable laws. We grant you a limited, revocable, non-transferable licence to use the Platform for its intended purpose. All rights not expressly granted are reserved.

12. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any Artist, design, or service will meet your expectations.

13. Limitation of liability

To the maximum extent permitted by law, TattooWallah, its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for the acts, omissions, or services of any Artist. Our aggregate liability arising out of or relating to the Platform is limited to the greater of the amounts you paid to us (if any) in the three months before the claim, or {{LEGAL_ENTITY}}’s minimum liability permitted by applicable law.

14. Indemnity

You agree to indemnify and hold harmless TattooWallah from any claims, damages, liabilities, and expenses arising out of your use of the Platform, your content, or your breach of these Terms or of applicable law.

15. Suspension and termination

We may suspend or terminate your access to the Platform at any time if you breach these Terms, misuse the Platform, or where required by law. You may stop using the Platform and delete your account at any time. Provisions that by their nature should survive termination will survive.

17. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at {{REGISTERED_ADDRESS}} (place of our registered office) will have exclusive jurisdiction over any disputes arising out of or relating to the Platform or these Terms.

18. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a revised “Last updated” date and, where appropriate, notify you. Your continued use after changes take effect constitutes acceptance.
